  • Spencer Elden Appeals Latest Ruling In Nirvana “Nevermind” Baby Case

    According to Billboard, Spencer Elden, the man who appeared on the cover of Nirvana’s “Nevermind” as a baby, has appealed the latest ruling on his “child pornography” lawsuit against the band. This news comes shortly after Judge Fernando M. Olguin dismissed the case once again.

    As previously reported, Olguin recently ruled that the album cover did not meet the criteria for “child pornography.” According to him, the photo is “analogous to a family photo of a nude child bathing.” He also referenced instances in which Elden recreated the album cover in 2016, got a “Nevermind” tattoo on his chest, etc.

    Despite this, Elden’s lawyer James Marsh says they “respectfully disagree” with Olguin’s assessment:

    “As long as the entertainment industry prioritizes profits over childhood privacy, consent and dignity, we will continue our pursuit for awareness and accountability.”

    For their part, Nirvana’s legal team are still up for the fight. The band’s attorney Bert Deixler says they intend to “resist with vigor and will prevail.”

    Elden initially filed his lawsuit after claiming Nirvana “intentionally commercially marketed the child pornography depicting [him] and leveraged the lascivious nature of his image to promote the ‘Nevermind’ album, the band, and Nirvana’s music, while earning, at a minimum, tens of millions of dollars in the aggregate.” He also claimed to have suffered “lifelong damages” as a result.

    Saint Asonia (Three Days Grace, Staind, etc.) will be releasing a new cover of Black Sabbath’s “Paranoid” on October 10. The band said the following about that:

    “We actually recorded this cover years ago while we were recording the ‘Extrovert’ EP. It didn’t end up on the EP, and when we recently lost Ozzy, we all talked, and decided now was the time to put it out there. It’s just our own little tribute to the band and the man who changed the landscape of heavy music forever, and opened the door for bands like us. We love you Oz.”

  • Shadow Of Intent Vocalist Ben Duerr Leaves Tour To Be Home For The Birth Of His Child

    Shadow Of Intent vocalist Ben Duerr has left the band’s current tour to be home for the brith of his child. During his absence, bassist Andrew Monias and Adam Mercer (ex-A Wake In Providence) will be filling in. The group commented:

    “This morning our vocalist Ben received the doctor’s call that his second child is going to be born any day now and we fully support his decision to rush home to be present for this important time in his life. We will still be playing all shows while we are out with Lorna Shore. Tonight we will be playing an instrumental set, our next 3 shows will feature our bassist Andrew Monias on vocals until Arizona our friend Adam Mercer will be holding down the mic.”

  • Cave In’s Stephen Brodsky Says He Is Planning To Release A New Compilation Of His Acoustic Covers

    Cave In’s Stephen Brodsky has revealed that he is planning to release a new compilation featuring his recent acoustic covers. He confirmed the news while promoting a November 1 show at YMCA Of The North Shore in Rowley, MA:

    “Hey, so remember all those acoustic hardcore covers I did earlier this year? They’re gonna be released as a collection (more on that soon) and I’m playing some shows to celebrate First show is at a camp site inside a cabin in ROWLEY MA. And I think there’s only 70 tickets available. It’s a great spot – played there years ago at the very first @wearyourwoundsofficial show. Date is NOV 1st – less than a month away… sorry to drop this on you so last minute, in a world where these things are usually planned like 18 months in advance.   • Trivium Part Ways With Drummer Alex Bent

    Trivium have parted ways with drummer Alex Bent. A replacement has yet to be revealed.

    Bent commented:

    “I am beyond grateful for the incredible past 9 years with Trivium—filled with unforgettable moments, music, and friendships that I’ll always carry with me. I’m so proud of every record and tour we created together, and I know Trivium will continue to dominate the world; they’ll always have my support. While this chapter has come to a close, this is by no means the end of my path as a musician. I’m excited for this new chapter, and I look forward to continuing to create, perform, and share music in new ways. Thank you to everyone who has supported me along the way. Your encouragement means the world.”

    He later added:
