Phil Labonte Says All That Remains “Can’t Do Anything” That Has Late Guitarist Oli Herbert’s Name On It

During an interview with American Songwriter, All That Remains singer Phil Labonte revealed that the band “can’t do anything” with late guitarist Oli Herbert’s name on it due to the financial dispute between them and his widow Elizabeth Herbert. This includes benefits that the group wanted to do in his honor.

Labonte said the following:

“We talked about ideas to do a benefit to raise money for kids in schools, but we can’t do anything that has his name on it.”

He also went on to say that the band have always paid everything owed to Herbert’s estate:

“We’ve made sure that that our accountants and all the people that work with us know any money that is owed to Oli Herbert’s estate must be paid to Oli Herbert’s estate. And we have absolutely no interest in not paying. It’s not worth any kind of hassle for the amount of money.”

He also added the following about wanting to start a school music program in honor of Herbert:

“Oli absolutely loved music. And I would love to see kids that don’t feel comfortable, the kids that are kind of awkward, or a little weird—I would love to see them look at Oli and be like, ‘I could be a rock star too.’ Because Oli, he was kind of a weird dude too.”

As previously reported, Oli passed away in October 2018 and police were investigating his death as suspicious. His body was found in a pond near his home in Stafford Springs, CT and he had unprescribed antidepressants and sleeping aids in his system. Elizabeth later revealed that his death was the result of drowning by issuing an odd sounding statement.

One week before Oli’s death, the guitarist also signed a will making Elizabeth the sole executor and benefactor. It also said that his sister Cynthia Herbert was not allowed to become executor or receive anything from his estate and that Elizabeth would get all “property as well as any current or future earnings.”

Labonte previously expressed frustration with the lack of an arrest in Oli’s death, while seemingly referencing Elizabeth, who he previously called a “garbage human being.” Fans and friends have long thought Oli’s death was suspicious and were previously sharing evidence on a Justice For Oli Herbert Facebook page.
