Judge Dismisses Sexual Assault, Etc. Lawsuit Filed Against Marilyn Manson By His Former Assistant

According to CBS News, Los Angeles Superior Court Judge Michael Stern has dismissed the lawsuit that was filed against Marilyn Manson by his former assistant Ashley Walters. The judge cited the statute of limitations, saying that “the plaintiff has pleaded too few facts and too late to keep this case in court.”

As previously reported, Walters was suing the shock rocker for sexual assault, sexual battery, sexual harassment, intentional infliction of emotional distress, and more. Her lawyers are currently planning to appeal the judge’s latest decision. They said the following:

“We are deeply disappointed in the court’s decision today. If allowed to stand, this decision would drastically limit the ability of victims of abuse to obtain justice through the legal system. We clearly pleaded the facts of this case in the complaint detailing the trauma and abuse Ashley endured, which prevented her from coming forward sooner. While the court based its decision on the timeliness of Ashley‘s claims and not the merits, we disagree with the court’s interpretation of the law as it applies to equitable estoppel and the delayed filing of abuse claims. We remain confident that a full review of the facts in this case will result in a successful appeal, which we plan on filing.”

Walters added:

“Nobody gets to choose exactly how they process abuse or threats. I am disheartened in the court’s decision today not just for my case, but for the message it sends to other survivors out there trying to balance how they process abuse with arbitrary court deadlines. We will not let this hurdle stop us from shining a light on what happened to me and others.”

Manson is currently facing abuse allegations from at least 16 women. Those accusations were initially spurred by actress Evan Rachel Wood, who said that the musician “horrifically abused [her] for years.” Since then many more women have come forward with allegations against the singer, including Walters, actress Esmé Bianco, who filed a lawsuit after accusing him of abuse and human trafficking, actress Bianca Allaine, who described him as the “most terrifying person [she has] ever met in [her] life,” actress/model Ashley Morgan Smithline, who filed a lawsuit after being sexually assaulted and abused multiple times, and another woman, identified as “Jane Doe,” who filed a lawsuit after accusing him of rape and death threats.

For his part, Manson has continued to deny the allegations and has even filed a defamation suit against Wood and her significant other Illma Gore. However, Wood has since commented on the lawsuit, saying that she is confident that she has the truth on her side.
