According to the Hartford Courant, Elizabeth Herbert, the widow of late All That Remains guitarist Oli Herbert, is currently involved in a legal battle over the band’s profits. Her attorney has filed a three-page letter in probate court, saying she is owed for shows the group played following Oli‘s death and that she hasn’t received financial records.

The letter said the following:
“There have been tours and shows played by All That Remains since Oli Herbert’s death about which the estate, as part owner of All Things Remain Inc., hasn’t been notified by being sent its copy of the profit and loss statements nor has the estate been paid its equal portion of profits as tour pay.”
As previously reported, Oli’s body was found in a pond near his home in Stafford Springs, CT back in October 2018. Police have been investigating his death ever since, treating it as suspicious. Notably, Elizabeth’s computer and phone records have since been seized as part of their investigation.
One week before Oli’s death, the guitarist signed a will making Elizabeth the sole executor and benefactor. It also said that his sister Cynthia Herbert was not allowed to become executor or receive anything from his estate and that Elizabeth would get all “property as well as any current or future earnings.”
Back in February, All That Remains frontman Phil Labonte said he couldn’t comment on the ongoing investigation, but did say Elizabeth is a “garbage human being.”
Fans and friends have long thought Oli’s death was suspicious and have been sharing evidence on a Justice For Oli Herbert Facebook page.
