As previously reported, former Turnstile guitarist Brady Ebert was recently charged with attempted first-degree murder, first-degree assault, and two counts of second-degree assault after running a car into William Yates, the father of the group’s frontman Brendan Yates. However The Baltimore Banner are now reporting that the musician has been declared mentally incompetent to stand trial .
Police previously said Ebert was caught on surveillance footage at William’s home, honking and shouting obscenities. William appears to have tried to wave Ebert off, but he responded by swerving at him. As such, William threw a rock and hit his car.
Ebert then retaliated by striking William in the driveway. William, who suffered trauma to his legs, claims Ebert later returned, saying he “deserved it.” He also confirmed that Ebert has continued to cause issues following his firing from Turnstile.
Ebert was initially accused of second-degree murder, but the charge got upgraded due to the “clearly targeted attack.” As such, he could face life in prison.
Despite this, Ebert apparently told the district court commissioner that there is surveillance footage that contradicts the police’s assessment of the situation. He was quoted as saying: “I’m sorry, but this is pure self-defense. I was straight-up attacked.”
Notably, he has continued to deny the charges, saying “every part of the police report is a lie” and that he “did not commit a crime.” During the latest trial, he was also said to be agitated and yelling. He also claimed to have fired his legal representatives, who were present for the hearing.
Montgomery County Circuit Court Judge Karla Smith ultimately declared Ebert mentally incompetent. He was then remanded to the Maryland Department Of Health. Another competency check is scheduled for January 19. His attorney Mark Sobel commented:
“Hopefully, he’ll get the proper treatment for his competency to be restored, so we can proceed to trial in this case.”
