As previously reported, Theobald “Theo” Lengyel (ex-Mr. Bungle) was arrested back in January in connection to the murder of his girlfriend/ex-wife Alice “Alyx” Kamakaokalani Herrmann. Now, a month into the trial, new evidence has surfaced in the form of a recording that captured the killing.

According to The Berkeley Scanner, Herrmann had clicked the record button on a cellphone app called “Just press record” prior to the violent altercation that ended in her death. Prosecutors said the disturbing audio showcases the “defendant’s brutality against the victim during the last 50 minutes of her life” and that it proves “the murder was intentional and involved torture.” They continued:
“From 10:40 p.m. to the time of her death at 11:33 p.m., Defendant has Ms. Herrmann under some form of physical restraint, or threat of violence, where she is unable to leave or get away from him. At different times during these 53 minutes where Defendant is either sitting on top of Ms. Herrmann or restraining her arms, Ms. Herrmann attempts to struggle out of the restraint and is able to punch Defendant once.”
They went on to say that during the last 46 minutes of Herrmann’s life, Lengyel “subjects her to physical violence, painful restraint, and multiple episodes of strangulation before she is ultimately killed during the final episode.” Prosecutors also added that the last few minutes of the recording found Herrmann “screaming for her life” and begging Lengyel to stop, but he refused. The trial was temporarily delayed so prosecutors could enter the new evidence. However, a request to give Lengyel life without parole was denied for now. The jury was expected to hear the new evidence during a trial on September 30.
