Allegations Of Domestic Violence & Drug Abuse Surface In Ill Niño’s Legal Battle

According to The PRP, allegations of domestic violence and drug abuse against Cristian Machado have surfaced in Ill Niño’s legal battle. The latest accusations came to light after Dave Chavarri responded to the allegations Machado, Ahrue Luster, and Diego Verduzco leveled against him.

To catch everyone up, the band is currently split into two, who are both fighting to take control of the name. One group includes Chavarri, Lazaro Pina, and Daniel Couto, along with new members Marcos Leal (Shattered Sun), Sal Dominguez (ex-Upon A Burning Body), and Jes Dehoyos (Sons Of Texas), while the other group includes Machado, Luster, and Verduzco. In the 53-page complaint that Machado, Luster, and Verduzco filed against Chavarri and Pina, they claimed that Chavarri failed to pay for band related services, kept money from bands that bought onto their tours, pocketed guarantees and tour advances, falsified documents for financial gain, etc.

Now, Chavarri’s team have responded by denying all the accusations, while also accusing Machado of being a “drug addict and physical abuser,” who assaulted his former fiancée and mother of his child. Those claims were backed up with a restraining order that the woman filed against Machado last December. Furthermore, Machado and Luster were both accused of missing child support payments, which caused Luster’s passport to be revoked and Machado to “effectively hold the band hostage prior to shows, requesting advances for his child support payments before playing.” On top that, Machado also allegedly obtained and used prescription drugs and weed illegally, interfered with finalized agreements with promoters, etc. Chavarri also claims that the band failed to pay him tens of thousands of dollars in management commissions and that the Ill Niño trademark rights were never properly assigned to the band’s LLC.

Chavarri is seeking to have Machado, Luster, and Verduzco’s claim for the trademark dismissed. He also wants to be declared as the sole owner of the band’s trademark and he wants the trio to pay for damages from their “unjust enrichment” through the trademarks and the cost of his legal fees. He is currently requesting a jury trial in Texas.
